The Personal Information Protection Act, which has been under long-term review since the fall of 2023, saw its amendment bill submitted in April 2026, and is currently under deliberation in the Diet as of May. During the review process, four pillars were presented based on the discussions: 1 Promotion of appropriate data utilization, 2 Regulations that appropriately address risks, 3 Prevention of improper use, and 4 Regulations to ensure the effectiveness of compliance. The amended law includes revisions based on these pillars. On the utilization side, there are special provisions for statistical compilation, including AI development (so-called AI special provision), and an expansion of exceptions to the obligations of personal information handlers. On the protection side, new regulations for the personal information of children under 16 years of age and regulations for specific biometric personal information (such as facial feature data) have been added. Furthermore, to ensure the effectiveness of compliance, including these regulations, supervisory powers and penalties have been strengthened, such as requesting third parties to take measures to cease illegal activities and introducing a surcharge system, making this a significant amendment. In terms of practical impact, for example, regulations for businesses entrusted with data processing have been added, necessitating revisions to consignment contracts and terms of use. This is expected to have a considerable impact not only on businesses that use personal information for product development and service provision but also on businesses that primarily handle employee information. Additionally, concerns about data provision for AI development have been raised during Diet deliberations, highlighting the need to be mindful of and accommodate individuals such as consumers regarding the amended provisions.
