Attention, workers—please safeguard your rights! The Ministry of Labor’s Labor Insurance Bureau has released the latest blacklist of occupational unions that are in arrears on insurance premiums and are prohibited from pre-collecting payments. As of August 18, four occupational unions across Taiwan have failed to pay premiums for Labor Insurance and Labor Occupational Injury Insurance, exceeding the grace period. The Bureau has legally referred these cases to administrative enforcement authorities and initiated a 'temporary denial of benefits' for their members. The Bureau urges affected union members to properly retain all payment receipts to avoid impacting future insurance benefits.
Labor Benefits at Risk: Labor Insurance Bureau Names 4 Blacklisted Occupational Unions
The four occupational unions publicly named and listed for arrears are:
- Greater Tainan Religious Services Occupational Union (Address: Annan District, Tainan City) - Keelung City Sculpture Industry Occupational Union (Address: Ren’ai District, Keelung City) - Taoyuan City Apartment Building Management Services Occupational Union (Address: Zhongli District, Taoyuan City) - Taipei City Fitness Instructors Occupational Union (Address: Zhongshan District, Taipei City)
According to Article 40 of the Enforcement Rules of the Labor Insurance Act and Article 36 of the Enforcement Rules of the Labor Occupational Injury Insurance and Protection Act, occupational unions that accumulate two months of unpaid premiums are legally prohibited from pre-collecting insurance premiums from members. Therefore, the above four unions are now strictly banned from collecting premiums in advance. The Bureau urges all workers not to prepay any funds to these unions to avoid financial loss.
What Happens If a Union Is in Arrears? Experts Share Two Remedial Measures to Protect Benefits
When unions fail to remit premiums to the Labor Insurance Bureau on time, members may be unable to claim benefits. Many grassroots workers express frustration: 'I paid every month—why can’t I receive benefits?' The Bureau clarifies that while members may face 'temporary denial of benefits,' workers need not panic. They can recover their rights through two channels:
Solution 1: Submit Payment Proof for Normal Benefit Approval
If members can present official receipts, bank transfer slips, or signed acknowledgments proving they paid their share of premiums and late fees to the union, the Bureau will verify the facts and approve all insurance benefits accordingly.
Solution 2: Individual Payment for Those Without Proof
If receipts are lost or payment proof is unavailable, workers can proactively coordinate with the Bureau. By first paying their portion of the outstanding premiums, the Bureau will process benefit claims upon receipt, ensuring coverage remains intact.
Severe Penalties for Premium Misappropriation! Bureau Warns: 'Nominee Enrollment' Is Forbidden
The Bureau sternly warns that union officials who misappropriate members’ insurance premiums will be referred to prosecutors for investigation. Such acts constitute embezzlement under criminal law, leading to imprisonment upon conviction, with all illicit gains confiscated. Union board members and supervisors must fulfill oversight duties and proactively disclose financial information. Workers should always request and retain official receipts after each payment.
Additionally, the Bureau emphasizes that workers must avoid the ultimate pitfall of the labor insurance system: 'nominee enrollment.' Labor insurance is an 'employment-based insurance' and only applies to individuals actually engaged in work. Paying a union to register under a false employment status carries severe consequences if discovered:
Cancellation of Eligibility and Nullification of Work History: Invalid enrollment status will be immediately revoked, and all labor insurance seniority accumulated during the period of enrollment with the union will be reset to zero.
Premium Forfeiture and Benefit Recovery: All previously paid insurance premiums will not be refunded. If any insurance benefits have already been received, the Bureau will legally demand full repayment of all amounts.
