(CNA, Huang Kuo-fang, Chiayi City, July 9) A woman, identified by her surname Huang, who had long suffered domestic violence from her husband, surnamed Chuang, fatally stabbed him during an argument last August. The Taiwan Chiayi District Court, with a jury, announced its verdict today, sentencing Ms. Huang to 7 years in prison. The case is still appealable.
The Chiayi District Court stated that Ms. Huang, who lived with her husband in Shuishang Township, Chiayi County, got into an argument with him. She then fiercely stabbed her husband multiple times with a fruit knife. Family members living with them reported the incident to the police. Mr. Chuang was rushed to the hospital but succumbed to his injuries.
The Chiayi District Court said that Ms. Huang, suspected of murder, confessed to the crime during the investigation and trial. However, she did not report the incident to the police immediately. By the time she confessed, the police already had concrete evidence and reasonable suspicion that Ms. Huang had committed murder, thus not meeting the criteria for voluntary surrender.
The court stated that the jury, considering Ms. Huang's demeanor during the trial and her medical records, found the conclusion of the physician from Taichung Veterans General Hospital Bay-Chiao Branch credible: "The defendant's ability to recognize the unlawfulness of her actions or to act in accordance with such recognition was significantly diminished at the time of the offense." This allowed for a reduced sentence under the Criminal Code of the Republic of China.
The court further elaborated that while Mr. Chuang initiated the dispute before the incident, his actions were not excessively aggressive. However, Ms. Huang killed her husband, who sustained multiple stab wounds. The circumstances were serious, and there were no grounds for a further reduction of sentence due to exceptionally sympathetic circumstances under the Criminal Code.
The jury, in its deliberation, considered the detailed facts of the conflict and applied the provisions for sentence reduction under the Criminal Code. They determined the maximum sentence for Ms. Huang was 9 years of imprisonment. Taking into account mitigating factors such as the long-term domestic violence she endured, her role as the primary caregiver for her blind mother-in-law and three minor children with developmental delays, and her poor economic situation, the court decided to reduce her sentence to 7 years of imprisonment.
