On the day in question, the defendant and the victim were in a heated argument. During this altercation, the victim claimed she was forcibly subjected to oral sex, leading to the defendant’s arrest, detention, and subsequent indictment on charges of non-consensual sexual intercourse.
The defendant admitted to attempting indecent acts but denied performing oral sex, partially contesting the prosecution’s allegations.
In this case, there was little objective evidence supporting the alleged act. Therefore, the trial primarily focused on the credibility of the testimonies provided by both parties.
The defense argued that the victim’s testimony lacked credibility, while the defendant’s account should be trusted, conducting a detailed analysis of both testimonies.
After the conclusion of the trial and before the verdict, a settlement was reached with the victim limited to the charge of non-consensual indecent acts. On the day of the verdict, after reopening arguments and examining the settlement agreement as evidence, the court delivered its judgment.
On June 9, Reiwa 8, the Koriyama Branch of Fukushima District Court acknowledged some degree of credibility in the victim’s testimony but pointed out several issues: insufficient supporting circumstances for her credibility, unnatural aspects in the reporting process, and possible motives to exaggerate the harm. The court stated that the defendant’s testimony could not be entirely dismissed and therefore did not recognize the act of oral sex. Instead, it found the defendant guilty only to the extent of attempted non-consensual indecent acts, such as attempting to kiss the victim.
The sentence was 8 months in prison with a 3-year suspended sentence, far below the prosecution’s request of 5 years.
